Terms of Use
Terms governing use of EyeSRCam and this website.
1. Acceptance and authority
These Terms of Use (“Terms”) are a binding agreement between the user and Trinity Basin Systems (“TBS,” “we,” “us,” or “our”). By downloading, accessing, or using EyeSRCam (the “App”) or this website, the user accepts these Terms and our Privacy Policy. If the user acts for an organization, the user represents that the user has authority to bind that organization. If the user does not agree, the user must not use the App or website.
2. Intended use and no safety-critical reliance
EyeSRCam displays information from compatible device cameras, USB-connected cameras, device sensors, location services, and operator inputs. The App may assist with observation and situational awareness, but its outputs may be delayed, incomplete, inaccurate, unavailable, misaligned, or affected by hardware, mounting, calibration, environmental conditions, permissions, software, network or satellite availability, and operator error.
Do not use EyeSRCam as the sole or primary means of navigation, aircraft control, target identification, collision avoidance, emergency communication, dispatch, search-and-rescue decision-making, protecting life or property, or satisfying a legal or regulatory duty. The operator must independently verify all information before acting on it.
3. Operator and organizational responsibility
The user and the user's organization are solely responsible for:
- operating aircraft, cameras, mobile devices, and connected hardware safely and lawfully;
- maintaining required training, licenses, registrations, authorizations, waivers, insurance, visual observation, and operational procedures;
- complying with aviation, privacy, surveillance, recording, intellectual-property, export-control, public-records, evidence-handling, workplace, and other applicable requirements;
- obtaining required notices, permissions, and consents from affected persons and property owners;
- validating calibration, compatibility, location, heading, range, bearing, imagery, and all other displayed information before operational use; and
- protecting devices, recordings, exported files, credentials, and confidential or mission-sensitive information.
4. No professional, emergency, or governmental assurance
Information from EyeSRCam is not legal, aviation, engineering, medical, law-enforcement, emergency-management, or other professional advice. The App does not contact emergency services, dispatch resources, certify evidence, guarantee chain of custody, or establish compliance with any governmental or agency standard. A reference to public safety, search and rescue, inspection, or another operational use describes a potential use case and is not a representation that the App is approved, certified, or suitable for that use.
5. License and ownership
Subject to these Terms, applicable open-source licenses, and applicable app-store terms, TBS grants the user a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use EyeSRCam for its intended lawful purpose. TBS and its licensors retain all rights not expressly granted. The App, branding, website, documentation, and original content are protected by applicable intellectual-property laws.
6. Prohibited conduct
The user may not: violate law or another person's rights; bypass security or access controls; introduce malicious code; interfere with the App or website; misrepresent affiliation with TBS; use the App to facilitate unlawful surveillance, harassment, discrimination, or harm; or copy, modify, distribute, reverse engineer, or commercially exploit protected portions of the App except where applicable law or an applicable open-source license expressly permits it.
7. Recordings, exports, and user-provided material
The user retains responsibility for imagery, recordings, mission information, feedback, and other material the user captures, exports, or submits. The user represents that the user has all rights and authority necessary to use, record, retain, export, or provide that material. TBS does not control and is not responsible for an export destination selected by the user.
8. Third-party hardware, software, and services
Compatibility with a camera, device, aircraft, operating system, service, or other product does not imply endorsement, certification, partnership, or approval by its manufacturer or provider. Third-party products and services are subject to their own terms and may change, fail, disconnect, become incompatible, or be discontinued. TBS is not responsible for third-party products, services, acts, omissions, terms, data practices, or availability.
9. Updates, beta functions, and availability
We may add, modify, suspend, or discontinue the App, website, compatibility, or any feature at any time. Updates may be required for continued use. Test, beta, or prerelease functions may be incomplete and are provided for evaluation with additional risk of error or interruption. TBS does not guarantee that the App or website will be available, secure, uninterrupted, compatible, or error-free.
10. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EyeSRCam, THE WEBSITE, AND ALL RELATED CONTENT AND SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” TBS AND ITS LICENSORS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPATIBILITY, QUIET ENJOYMENT, AND RESULTS.
No statement or advice creates a warranty unless expressly set out in a separate written agreement signed by an authorized representative of TBS. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TBS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; PERSONAL INJURY OR PROPERTY DAMAGE; LOSS OF LIFE, DATA, RECORDINGS, REVENUE, PROFITS, USE, GOODWILL, OPPORTUNITY, OR MISSION CAPABILITY; OR COSTS OF SUBSTITUTE EQUIPMENT OR SERVICES ARISING FROM OR RELATED TO THE APP, WEBSITE, THIRD-PARTY HARDWARE OR SERVICES, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF TBS AND THE OTHER TBS PARTIES FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP, WEBSITE, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT THE CLAIMANT PAID DIRECTLY TO TBS FOR EyeSRCam DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US $100).
These limitations apply regardless of the theory of liability and even if a remedy fails of its essential purpose. They do not limit liability that cannot lawfully be limited.
12. Indemnification
To the maximum extent permitted by law, the user agrees to defend, indemnify, and hold harmless TBS and its owners, officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, damages, judgments, penalties, costs, and reasonable attorneys' fees arising from or related to the user's unlawful or unauthorized conduct, operation of aircraft or hardware, recordings or exported material, violation of another person's rights, breach of these Terms, or misuse of the App. This obligation does not apply to the extent a claim results from conduct for which indemnification is prohibited by law.
13. Governing law and informal resolution
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise. Before filing a claim, the user and TBS agree to make a good-faith effort for at least 30 days to resolve the dispute informally after written notice describing the dispute and requested relief. Nothing in this section prevents either party from seeking urgent injunctive relief or using a small-claims process where eligible.
14. Changes and termination
We may revise these Terms by posting an updated version with a new effective date. Continued use after the revised Terms become effective constitutes acceptance to the extent permitted by law. TBS may suspend or terminate access for misuse, risk, legal requirements, or discontinuation. Sections that by their nature should survive termination—including ownership, disclaimers, limitations, indemnification, and dispute provisions—will survive.
15. General provisions
If a provision is held unenforceable, it will be enforced to the greatest lawful extent and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. The user may not assign these Terms without TBS's written consent; TBS may assign them in connection with a reorganization, financing, merger, sale, or transfer of the business. These Terms, the Privacy Policy, applicable app-store terms, and any separate signed agreement constitute the applicable agreement concerning the App and website. If a separate signed agreement expressly conflicts with these Terms, that agreement controls for its subject matter.
